Data Protection Policy Grapevine

The protection of personal customer data is a special concern to Grapevine Technologies GmbH (hereafter "Grapevine"). All data will be handled exclusively on the basis of the statutory provisions (DSGVO, TKG 2003). The following data protection information informs the customer about the most important aspects of data processing in the context of the use of the Grapevine platform and related services.

1. Contact with Grapevine

If the customer gets into contact with Grapevine through the (quick) registration form on the website or via e-mail, the data provided will be stored for a period of six months for the purpose of processing the request and in case of follow-up questions.

2. Data Storage

The following data will be stored at moment of registration on the platform for the purpose of processing the contract, including the (registered) company name, company address, corporate tax number, e-mail address, telephone number, the name of the contact person and other data points the user provides voluntarily. The data provided by the customer is necessary for the fulfilment of the contract, data analysis tools available to the customer and/or for the implementation of pre-contractual measures. A data transfer takes place only with third parties whose involvement is required for the successful contract and process completion, whereby responsible logistic enterprises as well as third parties involved in the purchasing contract (buyer / vintner) are considered.
In the case of a completed contract all data relating to the contractual relationship is stored up to the expiration of the fiscal retention period (7 years), or until expiration of the product liability (10 years).
The data processing takes place on the basis of the legal provisions of § 96 Abs 3 TKG as well as Art 6 Abs 1 lit a (consent) and/or lit b (necessary for the fulfilment of the contract) of the DSGVO.

3. Website

By registering and agreeing to this privacy statement, Grapevine is entitled to use the customer`s company logo and name of the customer for advertising purposes in business conversations and on the Grapevine website. Grapevine will desist from using other customer data for marketing purposes.

4. Web-Analysis

The Grapevine platform uses the functions of the Mixpanel web analysis service based at 405 Howard Street, Floor 2 San Francisco, CA 94105. The analysis of the use of the website is carried out through the use of cookies. The information generated thereby is transferred to the server of the provider. The customer may prevent this process by not saving cookies in the browser used. Mixpanel acts on the basis of the "Privacy Shields" (appropriateness decision of the European Commission) and exclusively for Grapevine as far as regards order data processing.
The data processing takes place on the basis of the legal provisions of § 96 Abs 3 TKG as well as Art 6 Abs 1 lit a (consent) and/or f (legitimate interest) of the DSGVO.
The reason for the application of this tool in regards to the DSGVO (legitimate interest) is the improvement of the Grapevine`s service and accordingly the platform. The user data is pseudonymised.

5. Change of Data Protection Policy

Grapevine is still in the early stage of its development process, which is why parts of the services provided will be adapted over time, whereas the customer is notified of any changes and potential changes to this data protection policy or the general terms on a continuous basis.

6. Client Rights

The customer has the right to information, correction, deletion, restriction, data transferability, revocation and objection of his or her data stored by Grapevine. In the event of suspicion of unlawful data processing and/or suspicion of limitation of data protection claims, the customer may contact Grapevine through or the data protection authority.
